1. Acceptance of Terms
By registering on or using Nomad's Odyssey, you confirm you are at least 18 years old (for club admin and builder roles) and agree to these Terms and our Privacy Policy. If you do not agree, please do not use the platform.
2. Nature of the Platform
Nomad's Odyssey is a community platform only. We do not organize, supervise, sponsor, or participate in any ride, convoy, or event. All rides and events are independently organized by clubs.
3. Ride Safety Disclaimer — IMPORTANT
Nomad's Odyssey expressly disclaims all responsibility and liability for any ride, convoy, expedition, or event planned through this platform. Participation is entirely voluntary and at the participant's own risk. Club admins and participants are solely responsible for: complying with all Indian traffic laws and road safety guidelines; ensuring vehicles are roadworthy and properly insured; ensuring all drivers hold valid licences; using appropriate helmets and safety gear; and assessing road and weather conditions before any ride. Nomad's Odyssey, Futureunboxed India, its founders and employees shall not be liable for any accident, injury, death, or property damage arising from any ride or event, whether coordinated through this platform or not.
4. Club Registration
Registration is subject to our approval. We may decline without reason. Club admins must be at least 18 years old and legally capable of entering binding agreements. Registration fees are non-refundable after profile activation per our Refund Policy.
5. User Generated Content (UGC)
By submitting stories, photos, or any content, you: (a) confirm you own or have rights to share it and it does not infringe any third party's rights; (b) grant Nomad's Odyssey a non-exclusive, royalty-free licence to display it on the platform; (c) retain ownership of your content. We may remove any content violating these Terms without notice. You are solely responsible for your content and its consequences.
6. Prohibited Conduct
You must not post content that is: defamatory, abusive, threatening, or harassing; incites violence, hatred, or discrimination; is sexually explicit; infringes intellectual property; promotes illegal activities, rash driving, or road rage; is false or fraudulent; or violates any Indian law. Violations result in immediate account termination without refund.
7. Intellectual Property
All branding including "Nomad's Odyssey," "The Ride Is The Ultimate Liberation," "No is not in the list," the platform logo, and all design are the intellectual property of Futureunboxed India. Unauthorized reproduction or commercial use is prohibited and may result in legal action under the Copyright Act 1957 and Trade Marks Act 1999.
8. Limitation of Liability
To the maximum extent permitted by Indian law, Futureunboxed India shall not be liable for any indirect, incidental, or consequential damages including accidents from rides, data loss, or platform interruptions. Our total liability shall not exceed the registration fee paid in the preceding 12 months.
9. Indemnification
You agree to indemnify and hold harmless Nomad's Odyssey and Futureunboxed India against any claims, liabilities, damages, or expenses (including legal fees) arising from your use of the platform, your content, your participation in rides, or your violation of these Terms.
10. Account Termination
We may suspend or terminate accounts for Terms violations without notice. No refund shall be issued upon termination for violations.
11. Governing Law and Dispute Resolution
These Terms are governed by Indian law including the IT Act 2000, DPDP Act 2023, and Consumer Protection Act 2019. Disputes are subject to the exclusive jurisdiction of courts in Jaipur, Rajasthan, India.
12. Changes to Terms
Material changes communicated via WhatsApp with 7 days notice. Continued use after changes constitutes acceptance.
